These Terms of Service ("Terms") govern your use of Workforce Direct (workforcedirect.co.za). By registering for or using our platform, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the platform.
Workforce Direct is a South African digital talent platform. Access to the platform and its features is subject to registration, acceptance of these Terms, and where applicable, a valid subscription.
You must provide accurate and complete information when registering. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Workforce Direct reserves the right to suspend or terminate any account at its sole discretion.
By creating an account as a worker, you consent to your profile being made available to verified business subscribers on the platform for the purposes of recruitment.

Access to certain platform features requires a paid subscription. Subscription pricing is communicated directly upon enquiry. Contact info@workforcedirect.co.za to discuss access options. Workforce Direct reserves the right to adjust pricing with 30 days' notice to active subscribers.
Annual subscriptions lock in the rate for the billing period. Refunds are at the sole discretion of Workforce Direct. To enquire about subscription options, contact info@workforcedirect.co.za.
All platform content, design, code, branding, and functionality is the intellectual property of Workforce Direct. You may not copy, reproduce, distribute, or create derivative works from the platform without express written permission.
Workers retain ownership of the personal information they submit. By submitting a profile, workers grant Workforce Direct a non-exclusive licence to make that content available to subscribed businesses for recruitment purposes.
⚠️ These terms form a binding legal agreement upon registration as a business user.
All worker data accessed through Workforce Direct is licensed to you for internal recruitment purposes only. You acquire no ownership rights over any worker profile, contact detail, or document. This licence is non-transferable and terminates immediately upon the end of your subscription or breach of these Terms.
You may use worker data solely to evaluate, shortlist, and contact candidates for direct employment within your own organisation.

A breach of Clause 6.3 constitutes a material breach causing harm that is difficult to quantify. You agree to pay liquidated damages of R50,000 (fifty thousand rand) per worker profile that is resold, shared, or otherwise misused. Workforce Direct reserves the right to pursue additional damages where actual loss exceeds this amount.
Workforce Direct reserves the right to pursue legal action in any South African court of competent jurisdiction for breach of these Terms, including urgent interdicts, damages claims, and cost orders. By registering, you consent to the jurisdiction of the South Gauteng High Court or the Western Cape Division of the High Court.
All platform activity — including searches, profile views, and exports — is logged. These records may be used as evidence in any proceedings arising from a breach of these Terms.
Workforce Direct may, at its discretion, offer candidate verification services. Where verification is indicated on a profile, it reflects that supporting documentation was submitted and reviewed. It does not constitute a guarantee of accuracy, authenticity, or fitness for employment. Businesses remain solely responsible for their own due diligence before making any hiring decision.
The platform is provided on an "as is" and "as available" basis. Workforce Direct makes no warranty that the platform will be uninterrupted, error-free, or that any profile information is complete or current.
To the maximum extent permitted by South African law, Workforce Direct shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the platform. Our total liability for any claim shall not exceed the subscription fees paid by you in the three months preceding the claim.
Workforce Direct may suspend or terminate your access at any time for breach of these Terms, fraudulent conduct, or any other reason at its sole discretion. Upon termination, your licence to access and use worker data ceases immediately and all obligations under Clause 6 survive termination.
These Terms are governed by the laws of the Republic of South Africa. Any dispute shall be subject to the exclusive jurisdiction of the South African courts.
